¿Reconfiguration of the fact in the criminal trial?

Resumen

El Código procesal penal venezolano (“COPP”) contempla la “Congruencia entre Sentencia y Acusación” en el sentido que el acusado no puede ser condenado por precepto penal distinto al acusado. Pero no obstante ello también incorpora dicho Código normas
sobre ampliación de la acusación durante el debate en juicio, o el cambio de calificación del hecho, o, inclusive, el conocimiento de
un “nuevo hecho”. En el ensayo se plantean las diferentes variables de este cambio calificatorio y su relación con el citado principio de
congruencia como sustento constitucional del sistema acusatorio penal. Pretendemos encontrar algunas hipótesis de viabilidad de tales circunstancias “discongruentes” -si se nos permite la expresión- atendiendo a la noción de verdad de los hechos a ser concebido por el juez en su fallo, pero sin desatender la presunción de inocencia, si no hay eficiente desvirtuación de aquella, con pruebas. The Venezuelan Criminal Procedure Code (“COPP”) contemplates the “Congruence between Sentence and Accusation” in the sense that the accused cannot be convicted by a different criminal provision than the accused. However, this Code also incorporates rules on expanding the accusation during the trial debate, or changing the classification of the fact, or even the knowledge of a “new fact.” The essay presents the different variables of this qualifying change and its relationship with the aforementioned principle of congruence as the constitutional support of the criminal adversarial system. We intend to find some hypotheses of viability of such “incongruent” circumstances -if we may use the expressiontaking into account the notion of truth of the facts to be conceived by the judge in his ruling, but without neglecting the presumption of innocence, if there is no efficient distortion of that, with evidence.
