| Abstract: | Constituye un trabajo de investigación jurídica, concerniente a la problemática que en el derecho venezolano vigente existe, con relación a la oportunidad en que las sociedades mercantiles adquieren su personalidad jurídica, la diferencia con otros trabajos, es que este se ocupa de examinar el régimen de legalidad del sistema de inscripción registral del comerciante social, como uno de los elementos requeridos a los efectos jurídicos antes dichos. Sin embargo, por haberse encontrado gran cantidad de irregularidades detectadas para un período preciso (1952/2001), en esta primera fase, se ofrece al lector única y exclusivamente, aquellas orientadas hacia el examen de la legalidad como Organización del Registro Mercantil y del funcionario designado para su gestión, frente a las peticiones formuladas por los particulares con tal propósito, dejando para otra oportunidad lo atinente a la forma del otorgamiento de carácter protocolar o registral del instrumento. Con ello, proponemos el establecimiento de una nueva categoría de comerciante social dadas las implicaciones acotadas. |
| Description: | Contributions to the Problem of the Acquisition of the Legal Personality in the Corporations Mercantile Under Venezuelan Laws. The Register Commercial. Period 1952-2001. Refers to a legal research, concerning the problems in current Venezuelan law exists regarding the time that commercial companies acquire legal personality, the difference with other works, this is doing an analysis, of the whole legal regime of the registration system of Mercantile Corporation, as one of the elements required for such legal effect. However, we have found irregularities for a specific period (1952/2001), in this first phase, so the reader get exclusively, those oriented towards examining of the legality and Organization Registry, leaving for another opportunity as it pertains to the registration of the instrument. With this, we propose the establishment of a new social category of Corporation. |
