| Abstract: | El artículo 86 de la LOPNNA refiere el derecho de todos los niños, niñas y adolescentes (NNA) a defender sus derechos por sí mismos y la garantía de este ejercicio ante cualquier persona, instancia, entidad u órgano. Objetivo: analizar este derecho, desde la valoración bioética, basado en la determinación del nivel de conocimiento del personal de salud y padres y/o cuidadores, descripción de los procedimientos hospitalarios y caracterización de su cumplimiento desde percepción del NNA; en el Hospital Central Dr. Luis Ortega del Estado Nueva Esparta de octubre a diciembre 2017. Método: descriptivo transeccional, con muestreo intencional e implementación de tres (3) instrumentos para cada grupo poblacional y posterior análisis descriptivo y correlación de variables (X2 , p˂0,05). Conclusión: existe desconocimiento del artículo 86 y otros relacionados con la atención del NNA hospitalizado, en consecuencia no existen garantías para el cumplimiento de los derechos de NNA hospitalizado y del artículo 86 de la LOPNNA basado en el comportamiento de la institución hospitalaria, el personal de la salud y los padres y/o cuidadores; lo que demuestra una limitación para las actuaciones basadas en el principio de beneficencia y una restricción para la garantía de conductas no maleficentes que incrementan su riesgo y la vulnerabilidad del principio de justicia distributiva con NNA hospitalizados que muestran insatisfacción y no cumplimento de requerimientos importantes acordes a su edad y desarrollo.Article 86 of the LOPNNA refers to the right of all children and adolescents (NNA) to defend their rights for themselves and the guarantee of this exercise before any person, body, entity or body. Objective: to analyze this right, from the bioethical assessment, based on the determination of the level of knowledge of health personnel and parents and/or caregivers, description of hospital procedures and characterization of their compliance from the perception of the child; at the Dr. Luis Ortega Central Hospital of the Nueva Esparta State from October to December 2017. Method: descriptive, transectional, with intentional sampling and implementation of three (3) instruments for each population group and subsequent descriptive analysis and correlation of variables (X2 , p˂0.05). Conclusion: there is ignorance of article 86 and others related to the care of the hospitalized child, as a consequence there are no guarantees for the fulfillment of the rights of hospitalized children and of article 86 of the LOPNNA based on the behavior of the hospital institution, the staff of health and parents and / or caregivers; which demonstrates a limitation for actions based on the principle of beneficence and a restriction for the guarantee of non-maleficent behaviors that increase their risk and the vulnerability of the principle of distributive justice with hospitalized children who show dissatisfaction and non-compliance with important requirements according to his age and development |
