PERSPECTIVAS DEL RÉGIMEN METROPOLITANO DE CARACAS

RESUMEN
Las previsiones de la Constitución de 1999 para sustituir el Distrito Federal por el Distrito Capital, y el llamado constitucional a la creación de una entidad local metropolitana (Distrito Metropolitano) en Caracas, abren paso a una situación de confusión normativa, a raíz de la Ley especial de creación de ese Distrito, dictada por la propia Asamblea Nacional Constituyente (A.N.C.), unida a la evidente omisión en la creación del Distrito Capital, entidad federal integrante del mapa político territorial propio de un "Estado Federal Descentralizado", como califica el texto constitucional al Estado venezolano.
El panorama impreciso, se refuerza por la sentencia de la Sala Constitucional que al pretender interpretar el alcance de aquella Ley, profundiza el estado de confusión imperante.
La situación está dada por la ausencia de una entidad insustituible (Distrito Capital) y la inserción de una entidad local novedosa (Distrito Metropolitano de Caracas), que se pretende ungir como ¨sucesora¨ del Distrito Federal sin poder serlo, y con el añadido de descansar sobre una base legal deficiente que acentúa los espacios de conflicto con los municipios del Área, al atribuirle a la nueva entidad las mismas competencias que aquellos tienen.
El ambiente general, signado por un desbordado frenesí normativo, no permite hacer predicciones confiables; como alternativa, se opta por destacar los errores presentes en los planteamientos, con la esperanza de orientar correctivos.
ABSTRACT
The stipulations of the 1999 Constitution for the substitution of the Federal District for the Capital District, and the institutional clamor for the creation of a local metropolitan entity (Metropolitan District) in Caracas, open the way to a situation filled with confusion. This is due to the regulations resulting from the special Law for the creation of this District, dictated by the National Constituent Assembly, together with a clear omission in the creation of the Capital District, a federal entity which is part of the territorial political map, befitting a "Decentralized Federal State", as the Constitution defines the Venezuelan State.
'This confusing state of affairs is reinforced by the ruling of the Constitutional Office which, in interpreting the reach of that Law, further increases the present confusion.
'The situation is a result of the absence of a definite entity (Capital District), the insertion of a novel local entity (Metropolitan District of Caracas), supposedly to act as "successor" to the Federal District, which it cannot do, and with the further flaw of resting upon a deficient legal basis which stresses the conflict with the municipalities of the Area, as it ascribes to the new entity, the same attributions that the latter have.
'The general situation, characterized by a frenzied regulating rage, does not allow for reliable predictions; as an alternative, the option is to highlight the errors present in the proposals, with the hope that it may serve as guidance for amendments.
