| Resumen : | El propósito de esta investigación es analizar el Decaimiento de la Acción por Pérdida del Interés Procesal en el Proceso Laboral Venezolano. Al respecto, se establecieron como objetivos específicos: a) Describir la institución de la acción y las distintas corrientes doctrinarias que se han desarrollado en relación a la misma; b) Señalar la noción de Interés Procesal a la luz de la Tesis de acción en sentido abstracto; c) Indicar la noción de Interés Procesal a la luz de la Tesis de la acción en sentido concreto; d) Conocer los casos que en virtud de la Interpretación Judicial de la Sala Constitucional del Tribunal Supremo de Justicia ocurre el Decaimiento de la acción por Pérdida del Interés Procesal en el Proceso Laboral Venezolano e) Estudiar la Interpretación Judicial realizada por el Tribunal Supremo de Justicia en el Decaimiento de la Acción por Pérdida del Interés Procesal. Las interrogantes que se planteó la investigación fueron: ¿Qué debe entenderse por Acción?, ¿Qué debe entender por interés procesal de la Acción?, ¿En cuáles Casos ocurre el Decaimiento de la Acción por Perdida del Interés Procesal en el Proceso Laboral Venezolano?, ¿Puede ocurrir en el Proceso Laboral Venezolano el Decaimiento de la Acción por Perdida del Interés Procesal?. La metodología empleada fue de carácter Cualitativa. El nivel de análisis está referido a la investigación documental, para lo cual se consideró la lectura de leyes, textos y la jurisprudencia. Se emplearon técnicas de investigación documental fundamentadas en el análisis de las fuentes consultadas. Así, este trabajo se estructura en tres capítulos: El Capitulo I, resume el planteamiento de la investigación, las interrogantes formuladas, los objetivos de estudio y la justificación. El Capitulo II, contiene los antecedentes históricos-legales, los antecedentes de otras investigaciones realizadas a nivel de tesis de grado y las bases teóricas empleadas. En el Capítulo III, se establece el marco metodológico, señalando el tipo y nivel de investigación. Finalmente, se establecen las conclusiones y reflexiones a las que arribó la investigación y por último, se hace referencia a las fuentes consultadas. |
| Descripción : | The purpose of this research is to analyze the decay of Action for Loss of Interest Litigation in the Venezuelan Labor Process. In this regard, specific objectives were established: a) Describe the institution of the action and the various doctrinal currents that have been developed in relation to it; b) Report the notion of procedural interest of the action in respect Thesis Abstract c) Indicate the notion of procedural interest of the thesis as a concrete action d) Knowing the cases under the Judicial Interpretation of the Constitutional Chamber of the Supreme Court case the action Decay Loss of Interest Litigation in the Venezuelan labor process e) Study the Judicial Interpretation by the Supreme Court in the decay of Action for Loss of Interest Litigation. The questions proposed the research were: What is meant by Action, What meant by procedural interest of the Action?, In which case the decay of Action Litigation Loss of interest in Venezuelan Labor Process? , can occur in the labor process Venezuelan decay Action Litigation by loss of interest?. The methodology was qualitative in nature. The level of analysis is referred to documentary research, which was considered to reading laws, texts and jurisprudence. Research techniques were used documentary based on the analysis of the sources. Thus, this paper is divided into three chapters: Chapter I summarizes the research approach, the questions posed, the study objectives and justification. Chapter II contains the historical-legal history of other level research thesis and the theoretical foundations employed. In Chapter III, provides the methodological framework, indicating the type and level of investigation. Finally, the conclusions and reflections down to which research and arrived finally referred to the sources |
